I think is time some one challenge you and the other admins on this.
Here are 2 set of a unknown number of set that made it to people legally all
over the world.
Set 40489 "Mr. and Mrs. Claus' Living Room" where produce by LEGO
it was given out by LEGO as a promotion. Why aren't it in the catalog. Even
if it was cancel before it where in full production some set got out and it should
still be in there with a note.
Set 42113 "Bell Boeing V-22 Osprey" went in to production and where sold
by LEGO around the world before it was cancel by a couple of reason. Still it
to should have a entry again with a not that it was cancel.
Now let see if you and your friend can give us a really god and acceptable reason
why they aren't allowed in the catalog.

Added number to you picture.
The current "compare image" of 10312pb01 and 10312pb08 is wrong.
The 10312pb08 there is 50986pb005
The same "compare image" can be found there to.
The small bottom window on 50986pb005 looks like it's a Black print not a
clear one.

Based on the size of the Open Circle logo, you are right.
However, the main difference between 10312pb01 and 10312pb08 should be the lack
or presence of hinges / handles. In this case we have handles on both:

I think i have figure out what have happen here.
But first can you check if both of your part are 10312.
The left on can be 50986pb005 that's the only one that i have found with
a small open circle and have handles. (The black lower window is probably a photo
error)
Still a problem whit 10312pb01. I think the main picture for this part aren't
correct the part shown are 50986pb005. The 3rd picture do show a big open circle:
10312pb08 big open circle no handles
10312pb01 big open circle with handles
50986pb005 small open circle with handles
The set picture those part come from confirm this.
