Hello there!

I live in Germany and on december 8th 2023 i bought something from a seller in
the Netherlands.

on december 18th i get the following message:

from: *censored* Sent on: Dec 18, 2023 10:04
It was shipped last week but I forgot to set it on shipped.

Track & trace-code
3SKABAcensored

A day later i check the trace link and the Name in the adress field only has
my first name in it (see picture) I immediately contact the seller and ask him
to contakt PostNl to have them fix the adress. Hey replys with "That is something
PostNL did, not me. But I send them a message."

Then nothing happens until January 2nd the trace link updates to "delivery
failed" without any delivery atempt or a message in my post box to go get
the package at my lokal post office or something.

I contact seller again. For the next 24 days he asures me to contact posnl and
have them investigate where the package is because as u can see in the immage
it took post nl a while to sort everythin out. On January 26th seller contacts
me the package has arrived at his place again. And a big white sticker was covering
the rest of my name but for 12,50€ he would resend it to me.

Here my question: do i have to pay again for shipping?
If we cancel the order: can i only get back what i payed w/o shipping fee?

He states that in his Terms he stats "shipping on your risk" is that
even legal here on bricklink? afaik seller takes shipping risks.
What should i do now?

Hi,

If the seller is a company than he is responsible for shipping by law (they can
put in terms that its the buyers risk but it isn't).
If it is a private seller you have to obey his terms.

You can file a NSS if the seller (company) does not want to rrsend at their costs
or refund complete payment.

The name doesn't matter. The postal code has to be correct.

Resending is for the buyer.
If you want to cancel the order the seller also has to refund postage.

If it was not your fault (as the buyer) then the seller should either send at
their cost, or refund the entire amount paid.

If indeed the seller put on the correct address and PostNL (or it's partner)
messed that up then the seller can claim the original shipping with PostNL.
With that he can pay for a second chance on shipping

And the seller could not have corrected the address with PostNL once it is shipped

Although the fault lies with PostNL (or partner) they are not willing to correct
mistakes that they make while shipping is in progress.
