Hey folks, wanted to get some opinions. I have come across a store that sells
lots of minifigs listed as "NEW" but under each description, says something
along the lines of "collector owned, used for display purposes only".

Is this still considered "new" on bricklink? They have LOTS of minifigs
listed this way and seem to be a seasoned seller.

No, these should not be listed as new. You can report that under “problem centre
- item(s) for sale” and Bricklink will contact the seller to have the listings
properly posted as used minifigs.

Bricklink Definition: "New Minifigures - Minifigures are brand new, taken
directly from new sets or purchased as new in another form such as accessory
packs or Pick A Brick and have been handled only for sorting. Minifigures may
be listed as new either assembled or unassembled."

They should not be listed as "New"

I especially like the one listed as new but says, "Used" Some bitemarks
on one side of head.".

There is a very fine line between assembling a minifigure and bagging it for
storage, assembling a minifigure and putting it in a glass cabinet to display
it for sale at a convention or in a store, assembling a minifigure and putting
it in a glass cabinet to display it in a home and assembling a minifigure and
putting it on a shelf to display it in a home.

Personally, I try to avoid them all.

It is not fine line in regard to stating condition of items for sale. The definition
is clear. Displaying minifigures means they are no longer "new". The
issue of whether new minifigures can be assembled is mostly a matter of personal
choice, of either the seller, or the buyer. I do not assemble new minifigures
because I believe many buyers prefer them unassembled. But it does not relate
to whether they can be listed for sale as new.

So what is the difference between assembling and displaying a figure at a convention
or in a physical store, and displaying a figure in a glass case at home? The
difference is intention - one is displayed to sell and one is displayed to enjoy.
And how do you prove intention if seller is not upfront?

Is this still considered "new" on bricklink? They have LOTS of minifigs
listed this way and seem to be a seasoned seller.

Though a good and frankly salient point, your subject phrasing has some irony...
So let me reply playfully: Not new hereabouts, nor “is this new” as per TOS

That said, it's become more common a listing practice, even as you put it,
from “seasoned sellers”. The restriction on the use of terms such as “like new”
or “as new” within the listing comments of potential USED listings, has
been increasingly enforced. So naturally some (not many) are driven to alternative
methods of more accurately describing what they’re placing for sale ~ A misguided
approach to selling, albeit understandable.

I actually noticed this as well just after I posted and tried to edit the title
but alas found that this vintage forum does not seem to like you do that so I
just left it, ambiguous double meaning and all.

Just adds fun. Frankly as I see it, ambiguity in the subject line can attract
more of the curious or active minds to a post. The right minds I would do so
with our sales posts in the past. But keep that on the DL

You anyway quickly did away with any ambiguity with your second question. I sometimes
and regrettably, will use any excuse to be playful
