Hey guys,
I always had positive experiences on Bricklink but I am a bit stumped on a recent
order and would appreciate feedback on what to do.

Bought a set sold as NISB. Seller shipped it fast, but packed it very poorly
using an old Amazon box and only put a little bit of brown paper within the box
itself (the same one Amazon uses). Wasn't enough to even cover the set entirely.

The package was delivered squashed and the inner box of the set was damaged (both
squashed, creased and also ended up tearing on one spot).

I contacted the seller asking for a discount. They said that if they can get
a refund from the carrier, they will give me a discount, but since I didn't
"accept the parcel with reserve" I was most likely out of luck (worth
noting the courier just left it at reception, I didn't even have a chance
to meet the delivery guy).

I contacted the seller again, reminding them that it's their responsibility
to sell the product as advertised (especially considering it was packed REALLY
BADLY).
They have been ignoring me since.

What do you think I should do?

At first, I would open a NSR here on BL. The set was not as described.

* Open an NSS Alert on BrickLink (top left of your order page, Report problem,
then File a Non-Shipping Seller Alert)

* if nothing happens, a few days later open a PayPal claim/dispute whatever the

How can a NSS alert be helpful? The parcel was shipped (and arrived), so what

How can a NSS alert be helpful? The parcel was shipped (and arrived), so what
is the seller supposed to do with a NSS alert?

No customs involved (domestic purchase), and the outside box was damaged too
so I am positive it happened in transit.

As you described the box was squashed so it doesn’t sound like bad packaging
was an issue. Amazon boxes are designed for similar shipments after all. As
something damaged in transit the compensation should really come from the carrier.
As you are the one with the package you have a better chance for a successful
claim. Key in this situation is taking a picture of the box before opening it,
and contacting the carrier.

Also keeping in mind that a claim may take a month or two. It’s possible that
the seller is in the process of such a claim with the carrier. Did you send
them pictures of the crushed packaging?

Posting that you are considering leaving negative feedback unless you get a credit
may be considered extortion.

My reason for posting was to get input on how to proceed, and I also understand

+1 the seller made the contract with the shipping company not the buyer (unless
there are abnormal circumstances in certain places where it’s different that
I’m unaware of) and sellers are the only ones who can contact the postal company
for claims since they buyer never made the contract with them.

Hi. I can elaborate. I have worked many years in my past as a commercial shipper,
granted this is unusual experience.

The receiver of the package does have some obligations for things damaged in
transit even though they didn’t choose the particular carrier. One did ask the
seller to find a carrier after all. And you opened the package. Common carriers
have strong international protection against liability too. PayPal and Bricklink
have great protection for buyers, because frankly it’s not the expectation that
every buyer knows how to handle this situation efficiently. Given how infrequently
packages damaged in transit happens this can be seen as the cost of doing business.
Much easier for large companies to absorb, than hobby sellers. You have the
option of getting a payout from the seller regardless of their getting a successful
claim from the carrier. Perhaps they deserve it as you say, their packaging
was very bad.

Are you sure you haven’t told the seller anything? How do you know the seller
hasn’t read your post?

Here, just about every carrier seems to take a photo on delivery for parcels
that gets uploaded as proof of delivery. I imagine that also serves as a record
of any damage to the parcel (or lack of) at the time of delivery.

Quite the pickle, not only for you but for the seller as well.
Some thoughts how I would handle this as the seller.

One golden rule: the seller has the right to receive what he ordered in the state
that was described. No matter if he paid for extra tracking, insurance and what
not. It's the seller that should decide on extra insurance (or decide not
to sell if the customer doesn't pay it).

As a seller, I would like to know which compensation you were thinking about.
Maybe the amount is very reasonable, to make you happy and to avoid the hassle
for the seller. Did you make a suggestion which amount you would consider fair?

If the compensation is considered too high, I would offer the method that is
valid within (EU) e-commerce legislation. Every buyer has the right to cancel
the purchase and return the goods with the rights to a full refund. This includes
the original shipping costs.
The shipping costs for shipping back to the seller are for small businesses often
left up to the buyer.

Maybe you were just trying to say that small businesses often do that while big
businesses can afford to swallow the costs but there’s no difference in law between
small or big businesses: if there’s nothing in the terms (before the sale), then
it’s the seller who pays (or refunds) return shipping.

  Maybe you were just trying to say that small businesses often do that while big
businesses can afford to swallow the costs but there’s no difference in law between
small or big businesses: if there’s nothing in the terms (before the sale), then
it’s the seller who pays (or refunds) return shipping.

To answer the question above - no I haven't spoken to the seller further
but if they do read this thread, I would be very happy if they made contact following
my last email to them and I'd welcome them to also weigh in to the discussion.

To answer your question: I asked the seller if they were willing to offer a discount
but I haven't specified an amount, I was going to let them decide what they
felt was right and start from there. The set in question is not super expensive
so I don't think it makes sense to go through the hassle of returning it,
both for myself and the seller (which I believe would also lose out on Paypal
fees, in case of a return).
Bricklink price guide shows about 28% difference in value between new and used
versions of this set - if I had to give you an indication, I think something
between 8-15% would feel right as a discount, but this is based purely on personal
belief and I may be over/underestimating it.

Thanks again eveyrone for the feedback, I will wait a few more days just in case
and then file an NSS if they still won't communicate; hopefully this will
get us to talk about it.

You don't have to complete it quickly after 7 days (and mark this permanent),
but you can let it go for 2 weeks or more, as you wish.

But first open it; the Seller will have a red ribbon in his main page as a reminder
of a problem to solve.

If it's solved gracefully you can cancel the NSS.

I am not sure the laws in Italy, but for your country specifically you would
have to read the Codice del Consumo.

From my understanding EU consumer law provides that a merchant must repair, replace,
reduce the price or give you a refund if goods you bought turn out to be faulty
or do not look or work as advertised.

In the US it is the merchant's legal responsibility to provide the product
to the customer in the manner and condition described. For a merchant to do otherwise
is fraud.

In this instance the seller was negligent, unless you had an agreement with the
seller that you would accept less protection for a lower shipping cost or specified
in writing somewhere that you did not care about the box condition.

Amazon boxes do not have sufficient ECT (edge crush test) rating to product a
thin cardboard set.

The order for disputes is
1.) Try to resolve with seller via email.
2.) NSS
3.) Paypal dispute
4.) Card issuer

The negative feedback should be an afterthought compared to getting compensation,
and I wouldn't do it unless you had to escalate to a Paypal dispute or further.

Hey guys, I would like to ask for your input again on this.
Opened the NSS on Monday, seller answered right away stating they're waiting
on the outcome of the claim with the courier.

I wrote back shortly after asking them what they're intending to do about
the damaged item, and that their claim with the courier is independent from the
one between us as buyer and seller. Radio silence again since Monday, my question
about a discount has now gone ignored 3 times.

How long would you advise to wait? Should I just file a Paypal claim and attach
all the evidence, asking for a partial refund? Or is it good custom to wait for
the 2 weeks of the NSS to be over before taking action?
