A listing I came across, appears to be listed as New/Complete (because it does
not say Sealed nor Incomplete) The comment on the listing says this …

   New but no box. Parts are still sealed in their packaging. Instructions 9/10.

It was my understanding that it should be Incomplete, as all New listings should
have the box otherwise they are Incomplete. Am I correct in how I’m interpreting
the listing guidelines ?

you're correct -

Complete - Contents are brand new and may have been removed from their plastic
bags and handled for inventorying purposes only. Includes all contents that originally
came with set including extra parts, stickers, instructions (if any) and original
box/packaging.

Maybe the seller doesn't realise or made an error? as for used for it to
be complete it doesn't need to include the box to be considered complete.

So, and thinking about this back towards the early days of BrickLink …

My remembrance is, that in the beginning there was no minor-code for Set condition.
Effectively it was only New or Used. When the minor code came into existance,
all the existing listings were grandfathered in without a minor code.
If something is listed today, it will appear in the active listings report as
Sealed, Complete, or Incomplete. Thus, it might be possible that this listing
is sufficiently old as to be one covered by the earlier rules (the set in question
is from 2002, and may have been on offer for close to two decades).

I am also (very vaguely) aware, that after minor codes came in existence, there
was a period in time when bulk uploads were not enforcing a requirement to specify
S, C or I in the minor code field. Presumably that loophole was closed.

In light of all of the above, when is it appropriate to report a listing (such
as this one) for not being tagged as Incomplete ?

Last, but not least, because of the capabilities of the Edit More screen, it
may be possible to recycle old listings, for purposes otherwise frowned
upon.

It is always appropriate to report incorrectly listed items. It helps everyone
in the long run. Buyers are less likely to get something they weren't expecting,
sellers are less likely to get negative feedback, Bricklink's reputation
is improved, etc.

Just report it. The listing will (eventually) be removed, and the seller can
just add it back correctly.
