I bought 127 pieces from someone on bricklink and all of it is non-lego. All
of them have blank studs.

I contacted the seller, they said they were traveling out of town, but doubted
"ALL" of it was non-lego. (makes me think they knew at least some of
it wasn't LEGO)

I replied that I want my money back, wasted my time to validate EVERY piece is
fake, and then I also filed a paypal problem, just to keep traction.

Now they're saying that I need to pay for it to ship back to him and "once
he verifies it's exactly what was shipped by him, since he keeps a photo
of everything he inventories." then he'll refund me. I think that's
unreasonable.

1) I dont think I should have to pay to ship back trash he sent me.
2) I don't trust him to refund me entirely even if I did send it back to
him
3) If I send it back, I think he'll just try to resell it again and someone
else won't catch it.

Again, he says he's out of town and that he didn't appreciate I initiated
the paypal process (still trying to resolve it, just wanted to get it on the
books).

Am I being unreasonable? I don't think so. I'm also a seller and when
I make a mistake, I send the person a prepaid shipping label to print off and
send it back to me. I would think that would be more reasonable then expecting
me to invest more money just to get my money back...and it sounds like I'd
just be out both of the times it was shipped.

Additionally, do they lose their bricklink seller rights for selling non lego?

  1) I dont think I should have to pay to ship back trash he sent me.

unfortunately in these cases even if paypal rules in your favor you still usually
need to pay for return shipping unfortunately.

  2) I don't trust him to refund me entirely even if I did send it back to
him

if he is untrustworthy then complete the Paypal claim as then once return shipping
tracking shows delivered you should get the refund from Paypal even if the seller
doesn't refund it themselves

You are right across the board. Though I would not get into the "I wasted
my time to validate every piece" as it just raises the tension unnecessarily.
Validating 127 pieces probably took what? 6 minutes?

Out of curiosity, were they 'new' and if so from what country?

OK. I was asking as there was an issue with new clones being sold from overseas.
Though in fairness, in the case I recall the seller did state they were not real
lego. Not allowed on BL but at least he was honest about it.

Did the seller send you a return label?
