| Hi all,
twice in the past ten days, I have received a promotional email newsletter from
two different North American sellers I once bought from despite never having
agreed (or even been asked) to be sent those.
These emails are sent outside of the BrickLink store newsletter feature that
rightfully needs the buyer’s consent before being sent to them.
This is a violation of privacy and it has to stop. Is there anything in the BrickLink
rules about abusing buyers’ email address that’s communicated during the order
process?

Hi,
Note that it may not be the sellers doing that but someone else trying to pass
as them. IOW: a scam.
There’s been multiple instances of this with European sellers (German mostly).

to be originating from the seller themselves.

In the EU and UK there is - GDPR. You can tell a seller to stop sending marketing
messages and that you will report them if they continue to as you did not consent
to the collection of your email address for marketing purposes. If you know it
is them, you can also least favourite the store and set up a filter to delete
all future mail from them. I tend to do that for all spam, rather than trying
to unsubscribe from mailing lists.

to wait a while. In the mean time I was wondering if BrickLink itself had such
a policy.
I have put both these stores on my Dislike list but I wish there was some sort
of bigger liability for BrickLink sellers who do that.

if anything it is against GDPR. Sellers must also abide by local laws though.

then we will provide your name, postal address, email address, and phone number
(if available) to the seller for purposes of order fulfilment. Similarly, the
buyer also will be able to see the seller’s contact information. This information
will be available on the Orders Placed or Orders Received portions of our website.
Sellers you transact with may use your information to contact you for marketing
purposes and to ensure you are not circumventing any seller-specific terms
or requirements.
Whether than is meant to mean for the current order only, or for any future marketing
purposes too, is not clear. Given you can opt in to a mailing list for each seller
it seems unnecessary to allow marketing this way.
As there is a correct way to send marketing to potential buyers that have given
consent through mailing lists, I tend to email filter them out when sellers decide
to contact you when no permission is given - but then also need to least favourite
the store since it might cause problems if you order from them in the future
and filter all their emails straight to the bin.

If you are a EU citizen then you need to consent, whatever the store puts in
their terms. A USA seller needs to adhere to GDPR. That means, as you state correctly,
we need to give them consent. But many stores have T&Cs that go against local
laws. One big one is people claiming that once an order is shipped it is no longer
their responsibility. Well it damn sure is.

We don't have GDPR in the USA but we do have CAN-SPAM and I would be surprised
if sellers are adhering to it.
