| Hi everybody,
I have an issue with a MISB order I recently placed (and received) and want to
return to the seller for a refund, but am not sure about how to proceed with
it if the seller refueses.
Upon inspecting the received set box, I noticed that the tape seals seem to have
been carefully unglued and resealed, there is MINIMAL tearing on the box (it
is actually visible if you closely inspect the box photo the seller sent me,
the photo is not from a good angle and lighting, but I paid no attention to it
then, I didn't want to be nitpicky about it - mind you, the set is from 2023.,
not a discontinued set).
I already have an identical set, also MISB, and I weighted both of them, the
difference is 2 grams - now, I suspect the seller might have opened the set and
took the minifigure out, but of course I cannot confirm it without opening the
set - and if I do, I doubt I can return it to sender for a refund since it would
no longer be considered MISB (and also, how do I prove that I'm not the one
who took out a part/minifigure).
How should I proceed if the seller refuses a return and refund?

can happen.
Why did you buy the set? If to use it, then open it and check it. If for investment
then tell the seller you want to return it if you have doubts about their honesty.
How accurate are your scales, as minifigures are more like 5g than 2g.

I bought it for investment, I do not intend to open it. It is a new set from

Occasionally tapes don't stick correctly. I've even had a set direct
from lego where it has been re-taped.
If you believe it has been tampered with then tell the seller you want to return
it. You don't have to tell them why, just that you want a return and refund.

| To add to my earlier answer, I doubt many sellers here would open a set, remove
figures and reseal it, and sell as as new and sealed. Many sets sold will be
opened when purchased. Any seller intentionally removing figures from sealed
sets would soon be found out. Buyers have six months to leave feedback and get
a (paypal) refund.

| There are definitely shady sellers on bricklink, so I don’t think it’s out of
the question. Plenty of sellers list used items as if they’re new. Taking out
a fig and then claiming the set is sealed is just one small step past that.

That is the question, as Uncomplete Sets sold as Complete, used parts or minifigs

Because people make errors. The seller has obviously opened it and knows they
have opened it and declared it is opened but mistakenly not clicked on the complete
tickbox and left the default sealed tickbox clicked.
Report it and it will be removed.

I bought it for investment, I do not intend to open it. It is a new set from

1 gram accuracy says not much at all, it is calibration.
I had the same sets that had a weight difference of a few gram so, possibly,
2 grams isn’t that much but of course depending on the set.
I also have Beatles sets that came in 1 buy from Lego itself that have 2 overlapping
seals on all places a normal Beatles set has 1, other quite new sets I have like
a chess pirate set has seals that are loose or getting loose.
It is all about what you as a buyer wants, on the other hand you want it as an
investment but that is of no concern to the seller. If you want a mint set you
need to physically search for it yourself, it is hard to buy a set that is in
pristine condition.
Why, if it is a new 2023 set, don’t you buy it on the Lego website or shop or
in a toyshop?
That way you can check it better although Lego ships sets way less than most
BL sellers.

| It also very possible that someone purchased the set, took pieces out that they
wanted and then taped it back up as best they could and then returned the set
to the store they bought it from. The person you purchased that same set from
the store not knowing that it was opened.
This has happened to us at least three times when we purchased multiple sets
for breaking down for our inventory. One set was completely replaced with a bunch
of used Lego taped up inside the bags from the set. The other two times it happened
where someone purchased the set, assembled it and then partially disassembled
the set and taped the parts back up into the original bags and then carefully
taped back up the boxes, but, of course, did not put everything back in the bags
including some of the figs.
So, in short, it may not have been the seller that originally opened up the set
(if it does prove to have been opened).

I know this is a serious accusation (and also maybe even a fake accusation on
my side!) which I cannot prove or disprove without opening the set, that's
why I'd rather return the set to the seller - if I open it and discover that
indeed something is missing, how do I prove that I'm not the one who opened
it up and took a piece and also if I do return it to the seller the set lost
some value if it's not MISB anymore; I use a kitchen scale with 1g accuracy
Maybe I'm just too paranoid about the whole situation.
It is one of those sets you cannot buy from a LEGO store separately but you get
it as a gift after spending a certain amount of money, that's why I ordered
it from a BL shop.
I'll see what can be done with the seller, for now they are refusing a return+refund,
although their shop said nothing about not accepting refunds while ordering.
They have all positive reviews, one neutral, and not a single negative review,
I wouldn't like to ruin their praise.

It could be both.
Maybe, just open the set and build it.
That way you know if the set is complete (or not)
If something is missing so be it. Tell the seller and be happy what you get.
Reading your story it is not a big deal while it is a GWP from 2023.
This is what i would do.

| TLG has recently been including the paper bags in random sets. It could be that
one of them has paper bags, and the other doesn’t.
