Hello guys,

I am buyer from Taiwan and rather new to Bricklink. I ordered some bricks from
a USA seller in May 2022 and paid with USPS Priority Mail International Parcels
with insurance. The seller sent the package, but somehow the package was never
delivered. By checking the tracking with the number that the seller provided,
it’s very clear the package was sent to the wrong country and returned to the
seller after 4 months. (The seller also said he got the package back and everything
is intact.)

As I really want the bricks, I asked the seller to re-send the package. But the
seller said if I want him to re-send the order, I will have to pay for the shipping
again. I want to make sure BrickLink’s policy on this. I can understand it’s
not his fault, but USPS’s fault. But I thought with any business, it should be
seller’s duty to make sure the goods were sent the right way, no? He said the
USPS employee told him that “I” (not him) could get the shipping cost back through
insurance. Isn’t his duty to get the shipping refund as the seller? And since
the USPS didn’t fulfill their duty to send the package to the right destination,
doesn’t this mean the seller is a “Non-Shipping Seller” in Bricklink? (As the
tracking showed the package was not even in my country at any time.) Should I
just file NSS? The seller said he’ll look into the insurance this weekend, but
he has been very slow in responding to my messages. I am not sure if he really
wants to take care of this order. Should I keep waiting and see if he’s willing
to re-send the package? What should I do?

The seller should resend the package at his expense since it wasn’t the fault
of the buyer.
As far as I know buyers can’t file insurance claims but only sellers can.
I would file a nss on bricklink and a claim with PayPal (or with your bank if
you paid with them)
The seller may be slow in responding in hopes that the 6-month period will pass
and you would no longer be able to file a claim on bricklink or PayPal so I wouldn’t
let the 6-month window pass. You can always start a nss and cancel it if he resolves
it but you would have to start it before the 6-month window closes

Insurance is there for the benefit of the seller.
He should be checking with USPS and file a claim with them to at least get the
shipping cost back.

That being said, he should still ship it to you at his expense as it is not your
fault. This doesn’t have to wait for the claim to go through.

I would wait until Tuesday, and if no reply from him, file an NSS as he still
has the parcel and hasn’t shipped it to you.

In the meantime, you can create a wishlist for the items and see if you can get
it elsewhere.

Don’t wait too long, as the order will be purged after six months.
