| Hi,
I recently placed an order for 4 figures, all listed as new. 2 came in perfect
condition and the other two: one had a light crack which I can live with, the
other is cracked on both arms and covered in some type of residue. I contacted
the seller and sent them pictures but was assured there is no way they sent old
figures as all they sell are new and to check if I've confused it with a
figure from my own collection. I pulled the item and inspected them right out
of the parcel, don't own these figures apart from the ones from this seller,
and not sure how to proceed. I replied to the seller advising them of this, but
they seem rather defensive about it. They don't seem to have any negative
or neutral feedback so I don't know if they just didn't notice or something
genuinely happened during shipping which I find hard to believe as their packing
was great. I don't want to cause anyone trouble, but I also paid $18.29 for
the affected figure and was hoping they'd be new as advertised. Any recommendations
on what else I could do? I already looked into the pricing for a new torso and
it's going to cost 7$ + shipping just to replace it. I've attached the
pictures (I think it worked) in case anyone has seen anything like this before
and has any tips.

| I thought the same as you had mentioned when it was proposed. NSS by name doesn't
sound like it would be the right course of action until you start digging into
it. I'm really glad to have had so many people stop by and weigh in. I don't
typically handle these situations well as I normally just let them go. Happy
to have got all input from everyone.

I looked at the NSS terms page, so I missed the list of reasons for it as it
only talks about non-shipment of the order

except it would since the seller never shipped the items that they sold. They
sold a figure in new condition but sent them a mismatched dirty and broken figure
instead so the buyer is still waiting for the seller to ship what was ordered

| I looked into NSS and as the items were not correct (torsos were from different
figures) and one was used, it fit a reason to do so.
With that said, I spoke with the seller and we agreed on a fair compromise of
a partial refund to replace the torsos for the correct ones. I'll just clean
the figures and I'll just avoid the seller in future in case any of it was
intentional.
Due to the resolution I won't be submitting a NSS, negative feedback or otherwise.
Bit of a headache experience over items that were advertised as New, but glad
it's over with.

The best recourse would be asking for a refund, and if the seller denies it,
then submit a paypal dispute

| You're right...the legs are correct, but it looks like they both have the
wrong torso. Will have to replace both. Thanks again for mentioning that, didn't
notice when I checked them for quality.

Both minifigs are in the set #375305 in quantities of 2 each
The seller may have purchased either the set in used condition or a possibly
a used bulk lot from maybe someplace like Goodwill that contained the set and
he did not pay enough attention to the printing on each fig and bagged them incorrectly.

Arm cracks like that clearly show it has been used. If the seller is refusing
to accept it, NSS and PayPal claim, followed by negative feedback.

| I don't actually know. Whatever it is seems to come off fairly easily. I've
stopped cleaning them until I find a resolution.
