After being a member for many years wit an almost perfect rating and no issues
what so ever I had to find out myself today my store is suspended.I have not
been notified about this nor did get any warning there is an issue so have no
clue why or how to fix it. Very sad. I can imagine that when any of my current
buyers with an order that is not yet shipped come accross my suspended store
they get worried so I notified them all reassuring them orders will be shipped
as planned soon. Very annoying for me while on a short holiday. Thank you bricklink
for communicating. Are there any other stores that experience the same problem?
I already contacted the help center but it will probably take a few days before
I get a responds and still, if there is an issue it still has to be resolved.

No I don't. I find it very disturbing that bricklink takes such drastic measures
without even letting me know what's wrong. There's probably a little
issue where i'm not aware of and that can easy be straightened out if I had
only been contacted.

It seems my store was suspended for the next reason: buyers who had chosen paypal
onsite payment what requires expensive registered shipping did get the opportunity
by me to pay offsite as to a friend. This allows much cheaper unregistered shipping
without tracking so at their own risk but is just an offer, they still chose
what's comfortable for them. Since I don't demand a minimum buy I get
a lot of small orders, sometimes even 1 part for 10 cents or so. Getting the
opportunity to pay 2.55 euro shipping instead of 19.30 + costs is something many
of my overseas buyers were happy with. But unfortunately, WERE!!! This seems
not to be allowed and that's why I was punished. I was obviously not aware
of this restriction but bricklink thought it was necessary to suspend my store
without any notification, explanation or possibility to correct my method of
working. And this after being a seller for many years without any issues or complaints.
A real disgrace for the so wonderfull bricklink. Luckely my store is back online
but sellers be aware, check and double check policy because if you do something
what's not allowed and you're nat aware of you could be shut down just
like that.

Well, you’re supposed to have read both BrickLink and PayPal terms when you registered
for each

Of course not!
No one reads anything.

I remember a few years ago, one seller put a small line in his terms like "If
you read this copy this sentence in the order comment, and you'll get a 50%
rebate" - or even a free order, I don't remember...

He went in Forum saying none or 1 maybe saw and claimed it, on hundreds on buyers

In short, you can simply write anything in terms

Well I did. That's why I'm well aware I have to ship registered when
paypal was used to pay. After all, if someone buys for let's say 4 euro,
pays 7 euro for direct unregistered shipping and costs so 11 in total, I loose
that amount when he starts a PayPal claim for not receiving it because I can't
proove I have shipped but then again, neither can the buyer proove he did't
receive it. All that to save the buyer on shipping costs. I used to do it this
way in the biginning but was foold a few times so even since, paypal payment
= registered shipping and Paypal to a friend makes cheaper shipping possible
but at their own risk. This worked out for many years and hundreads of happy
buyers. My feedback proves that. Even in the 2 or 3 cases of lost unregistered
mail over all these years I did compensate in some way although I didn't
have to.
But rules change, I think the lego group taking over BL and the new tax rules
changed some things that remained unnoticed. I doubt there' any of the users
that's 100% well aware of the rules, even not the lawers among them.
I have no problem to follow the rules and to adjust my way of working when I
was unaware of not following the rules, it's the discrasefull way of acting
without communication from the administration that's bothering me the most.
They seem to forget they get paid from the 3% fee they receive from us sellers.
A 3% what's fine by the way. I'm very glad to contribute this for the
use of BL. But then again, what one diesn't buy in my store will be bought
in an other so probably won't make a financial difference for BL. I hace
always been over the moon for bricklink and praised it all over but are having
serious doubt because of the way the act, not why since this will probably correct.

Then you should have known that ‘friends & family’ is not for commercial transactions.

This isn’t new.  PayPal has always separated the two kinds of transactions and
has always been clear about the difference.

Contrarily to what you say in this thread, a seller with good reputation is not
‘friends & family’ of the buyer.

You had the audacity to try to clear up some red tape. The various agencies collecting
% fees and % tax on total cost to buyer are much happier with your buyers spending
19euro shipping instead of 2.5.
You're taking away their ill-gotten gains!

How does using Paypal Onsite require you to use registered shipping?

They mean buyers have no consumer rights if they pay a friend rather than a business,
so the seller doesn't have to worry about if the buyer gets the order or
not.

Jen

You need a tracking number for PayPal to get seller protection, so that is more
expensive than standard post without tracking.

And getting money as a friend for selling products is against PP TOS.

You make the assumption that everyone has friends.

If you pay via PayPal Enemies & Foes, then the PayPal fee is 200% of the grand

No I don't. I find it very disturbing that bricklink takes such drastic measures
without even letting me know what's wrong. There's probably a little
issue where i'm not aware of and that can easy be straightened out if I had

Luckely my store is back online
but sellers be aware, check and double check policy because if you do something
what's not allowed and you're nat aware of you could be shut down just
like that.

How does using Paypal Onsite require you to use registered shipping?

Jen

Belgian, and I assume worldwide, paypal rules state that by using paypal the
buyers gets buyers protection. If the orders gets lost in mail they get refunded
by paypal, that's why they charge 4% fee. So far no problem. But if the seller
can't proove he has shipped, his account will be credited by paypal so he
loses his money. In order to be safe the seller has to ship registered, only
then he can proove it's shipped, what's much more expensive. When the
payment is done as to a friend or family or someone you trust, f.e. a seller
with (almost) perfect feedback) shipping can perfectly be done unregistered so
much cheaper. Seller doesn't risk a claim, buyers does however take a risk
but then again, if you order for 2 euro + lets say 5 euro shipping and it gets
lost you loose 7 euro. If you have to pay registered shipping you pay at least
12 euro more so you loose 12 euro when it does arrive anyway.
Onsite payment only allows the regular paypal with buyers protection so registered
shipping is required unless sellers want to take the risk and calculate the possible
loss in raising there prices for everyone. Payment as to a friend is only possible
if payment is processed offsite bricklink, by logging in to your paypal account
and send to another. Nothing wrong with that when both buyer and seller agree
with it if you ask me but apparently not allowed by bricklink anymore. Did it
for years to great satisfaction of my buyers but won't anymore.

Two problems:

BrickLink needs to collect sales tax for most US sellers and, I believe, some
VAT for the EU as well. If you don't use Onsite for the transaction, then
this money ends up with you and not the tax authorities.

Justifying breaking the rules of Paypal by explaining how it is more fair and
cost-effective is still justifying. You gave yourself an advantage over other
sellers who followed the rules as stated or took the risk of shipping cheaply
to buyers upon themselves.

I am glad to hear that you are joining the rest of us in the lands of terms and
taxes.

Good luck with your shop!

Not for EU as it’s only for non-EU sellers but US sales tax & UK VAT for sure
and soon Canada’s taxes too.

That isn't a Bricklink change, it's a Paypal policy that has always been
in place. You are not allowed to accept business payments as "friends and family"
payments.

In the latest policy updates, effective 28 July IIRC, no one will be able to
send any F&F payments to/from business accounts.

The cheaters ruined it for everyone as I use it to legitimately send money to
family. It is going to be really fun to get my 78 year old mother to use CashApp
or Zelle, I just got her setup to use her bank on her phone, and that was a chore,
but now she loves it.

Can you still use PayPal Friends & Family to send money to a personal account?

Personal account to personal account as far as I can tell, they really do not
make the new policy easy to understand.

I'm pretty sure that its against paypals terms to do that. So be thankful
paypal didn't shut you down as well.

Buyers are your friends?

Some buyers here are VERY friendly, a couple of them are actual personnal friends,
but a commercial transaction is something else.

You simply can't do this.

I'm aware of this now and don't worry, it won't happen again. Who
ever is the first to say he/she never makes a mistake or never does something
not being aware it's not allowed is a ...
Rules are rules, also for me but we can al be wrong. I thought what I did was
good but aparently it wasn't although much appreceated by a lot of my buyers.
And yes, this might sound strange to some, but most buyers are my friends, even
if I don't know them personally. I would move heaven and earth for them to
serve their needs. Who ever treats me with respect is my friend. If anyone can
say the thousands of people they never met but are there friend on facebook and
so, are their friends, I can say that to about people I met on bricklink.
But anyway, this ins't the point here, I did wrong and this is now fixed.
What bothers me the most is that bricklink admin didn't contact me. They
didn't let me know that what I did wasn't right. Ok I should have known
this but as said, I didn't. They didn't give me a chance to correct my
way of working. They didn't even let me know my account was blocked, let
be why. It was one of my buyers who contacted me, very worried by the way, that
he couldn't access my shop anymore. If he hadn't I probably still wasn't
aware of the problem. Someone probably notified bricklink about the options I
had offered them. Ok, these were aparently not by the rules so I can't be
angree about that, on the contrary, I'm glad it happened and I have now been
able to correct it before worse things happened, but it's not that I have
been collecting money without sending orders. I acted in a way that I thought
was good for my buyers, and that was often to their satisfaction and much appreciated.
They were never forced, the choice was always theirs. Was it so hard for bricklink
admin to inform me I was doing something wrong, and what I was doing wrong? They
could still have suspended my store but at least I would have known about it
, why and what to do about it. I have never heard them complain about me paying
my monthly bricklink fee right away. And don't understnd me wrong before
some start throwing stones again, I have no problem at all with the bricklink
fee, It's all more than worth it. At the end it's like solving an issue
with an order, if there's communiction from both sides usually everything
gets resolved, at least with me, but when 1 doesn't communicate the other
is left behind with a feeling that he's mistreaded. I have always communicated
till the end what can't be said from others.
For me this case is closed and finished. It's solved, it won't happen
again.
One last thing, and this is not addressed to you personally Sylvain, to those
who felt the need to throw with nasty words here or in any other topic (second
thing learned, don't post a topic about just anything as they could bring
up the worst is some), he orshe who's without sin can throw the first stone.
This said I don't think anyone should get a stone thrown at.

I may not have understood them the same way you did.

Hello,

I'm currently experiencing a very similar situation.
I was suddenly suspended without any notice, but I think it's because of
dealing outside of BL.
I contacted BL with messages and tickets, but haven't got a response for
7 days.
May I ask how you got your suspension resolved and also how long it took you?

Thank you!

I think this entire thread lost sight of the main point of this post. The OP
was upset that their store was suspended without being notified why. I don't
think it is too much to ask, that when suspending a store, at least inform the
store of why they are being suspended so they can make the necessary changes
immediately.

Or, now I don't want to get all crazy and simplistic, but when noticing a
store has gone against some terms that maybe 3 people outside of sylvain have
read, maybe just send them a message alerting them to the problem and giving
them like 12 or 24 hours to fix the issue otherwise the store will be suspended.
I know what I just mentioned is way too crazy and common sense to ever work.
Just some food for thought.

I feel like this is pretty basic knowledge:

1. Don't pay for goods and services using PayPal Friends & Family (there
is no fee if you pay via friends and family)

2. Don't pay offsite if you're in the U.S. (BrickLink cannot collect
U.S. sales tax on offsite transactions, not sure if that applies in this case
since the seller is based in Europe)

That being said, it is always courteous to let someone know when they step out
of line.

It definitely does apply, but not if the buyer is in one of those states that
doesn't have a sales tax or doesn't collect taxes on Internet sales.

True.

How is VAT collected? Does BrickLink collect VAT automatically, or are EU sellers
responsible for collecting and remitting VAT to their local authorities? Or just
for transactions under £135/€150?

I know that paying by bank transfer is common in Europe, but that is mostly offsite.

I know that paying by bank transfer is common in Europe, but that is mostly offsite.

BL only has to collect VAT for imports below €150 for EU (= non-EU sellers),
and below £135 for UK (= non-UK sellers) (with the particular case of Northern
Ireland which is obviously UK but also ‘not non-EU’).

For intra-EU¹, the seller is either VAT-registered in EU¹ and must collect VAT
themself or they are not VAT-registered and ‘VAT doesn’t apply.’²

When you’re VAT-registered, you can use BL’s VAT feature: you enter your prices
VAT-included and the feature shows them VAT-included to EU¹ buyers and with VAT
removed to non-EU¹ buyers.

And I won’t get into the complicated subject of whose (buyer’s or seller’s) VAT
applies and on what it applies and how BL handles (or mishandles) that: there’s
a ton of threads about it in the Taxes topic.

—————
¹ There’s actually now three VAT zones: EU, UK, & Norway.  So you can replace
EU with UK or Norway above.  (Norway also has a marketplace law for imports but
BL doesn’t implement it.)

² I’m careful to say ‘VAT doesn’t apply’ because it’s not the same as ‘there’s
no VAT’.  ‘There’s no VAT’ could mean a 0% VAT, like for exports or B2B.  Non-VAT-registered
sellers in VAT countries pay VAT as buyers but they don’t care, don’t handle,
don’t account for, don’t talk about VAT (except by having to say ‘VAT doesn’t
apply’ on their invoices).

Thank you for the explanation, that makes a lot of sense.

I was just trying to understand how EU VAT differs from U.S. sales tax.

I feel like we can take that for granted.

Though it is also a PayPal issue not just a BrickLink issue.
