| Good day.
I hope I can get a little help here. This is the first time I’ve experienced
an issue quite like this.
I placed an order from a store on 4 March. It is my first order with that store,
but I’ve ordered from that country often enough before. Normally, it takes less
than a month to get to where I am.
I waited over a month. Nothing. Another order, which I had placed later arrived
from the same country. I sent the seller a message to ask about it, and he guessed
the package he sent was stuck in customs. (That has never happened to any of
my orders before.)
I waited some more and nothing came. The seller was never quick to reply (in
spite of his claims on his Terms page.) But, at length, after some courteous
back and forth with the seller, he sent me an image of the package label. It
turns out that the address he put on the package was incomplete. Parts of the
long address were cut off by whatever form this seller was using. Now, to be
quite clear, though I have ordered using the same postal service many times,
this has never happened before. I have no idea why the address was cut off.
Now, however, I am getting no response from the seller. I have been polite, starting
with, “How shall we proceed?” I thought the implication was clear. But I have
been waiting and waiting, and I am getting no reply. Two months after the order
was placed, my patience has run a little dry. Four days ago, I directly requested
a refund on the grounds that the error was the seller’s, and I cannot be expected
for goods that were never sent to me.
This is really annoying because, even though it was not a huge order, this store
has pieces I need to finish my MOC, and no other store on BrickLink sells them.
I was really willing to try to order again, but at this point I think I am done
with this seller.
So, to my question: Is it appropriate to file an NSS at this point? I do not
wish to rush into such a procedure if unwarranted.

I don't think it would be inappropriate, but the NSS would also likely be
removed once the seller sends proof of shipping to BrickLink. Have you started
a PayPal claim?

I have not started a PayPal claim. If the seller sends proof of shipping to BrickLink,
he would necessarily acknowledge that the address was incorrect. He has already
admitted that the address was wrong.

he would necessarily acknowledge that the address was incorrect. He has already
admitted that the address was wrong.

If he has sent it to the wrong address, he hasn't sent it to you. If they
are not responding, I'd start both the paypal and NSS. The seller is probably
waiting for the item to be returned.
What was missing from the address? Is it a road without a house number or similar?
Would the package be at a local mail centre and could you claim it if it has
your name on it?

Yes, but the primary purpose of an NSS is to alert the seller to the fact that
something is wrong, not to get your money back.

| This doesn't solve your issue, but -
Is it a Canadian seller? Back when we sold worldwide, we regularly had issues
with address lines being too long when shipping from Paypal through Canada Post.
CP has silly short entry fields, and especially with South Korean addresses we
had to be creative in stuffing address parts in them (we always managed though,
never had issues).

Same here. Had South Korean addresses truncated by the Paypal form. I had to
carefully move part of the address to a line lower down.
That may explain something. But still doesn't explain why seller doesn't
take responsibility for the error.
