As long has they have not been assembled, disassembled and the reassembled, they
in theory are still able to be sold as new. For me, I would sell them as used
for the reason that they could have had color fading due to light exposure or
other, but by rule I think it is still technically allowed.

So for those that have a brick and mortar store that get all their figs from
new sealed sets, assemble them and put them in a display case for retail (and
also have their BL store tied in) you would sell these as Used?
All I'm saying is that by rule I don't think they are doing anything
wrong and that if I were going to buy from them, that would be my question.
As for myself, I mainly resell bulk purchases or personnel sets that have otherwise
been displayed for my own personal benefit and would definitely not fit the "new"
criteria for myself.

assembling for the purpose of selling (and generally kindly put in a zip bag).
All in all, I don't agree with (and don't comprehend) this rule as "Assembled
= New" (of course, if the Minfigure wasn't assembled by LEGO when delivered).

Simply put, if a LEGO set (or a puzzle, or a car model kit, etc) has been assembled
by anyone other than the manufacturer, no matter the reason, it is no longer
new. Why would it be different for minifigures that also come unassembled? If
you need to build them to display them in a storefront, have at 'er, but
don't call 'em new; otherwise you're saying it's ok to assemble+display
for retail purposes, but not ok for personal purposes...

Personally, I wouldn't list them that way. But would they be removed if reported,
who knows? It depends if BL admins still think assembled and displayed figures
are borderline and leave them or whether they now do something about it. I
no longer bother reporting any like that if I see them, I just least favourite
the store.

I didn't report, just kindly signaled this to the OP.
I also wanted to mean that I personnaly wouldn't buy and Minfigure in this
Shop due to this "trickery" on the Condition.
While this - I would be also VERY happy if BrickLink would force Minifigures
listing to be clearly detailed as "Assembled" or "Never assembled".
I should make a Suggestion of this...

Some figures have add-ons like jetpacks etc. making it hard to build the figure
without the original instructions.

Like assembling bricks - or Plates!!! - for "safer shipment" or "save space",
or assemble Minifigures.
The manufacturer provides them unassembled, please do the same.

This whole thread comes off as pretty obsessive. A figure that's sun damaged
isn't going to be listed as new. A figure that was pulled from a set and
stored behind plexiglass in someone's basement is no different from one put
in a ziplock bag. I'd also argue a figure that isn't assembled is just
parts.
Regardless of any semantics though, you realize that the parts are more likely
to suffer damage if they're shipped/stored taken apart, right? Unless you

Ones displayed are often stood on plates or stands, might have been posed
rotating arms and hands, or have a weapon or accessory attached. They are used,
just like new parts that you use carefully once are used even if they still look
new.
If you put a cape on a figure, it becomes damaged. Some colour older parts from
~2012 may be made of the more fragile plastic and crack because they have been
assembled and bagged for 10 years, even if not used. The seller is unlikely to
open a bagged built figure to check things like that before sending, knowing
it was new when bagged. Some minifig parts are officially bagged, there is no
need to open those bags to build a figure for storage. In sets (and CMFs) parts
are bagged together so a seller bagging them together is no different. Also sometimes
I buy figures for a couple of parts then sell the bits I don't want. If they
are assembled by the seller, then I cannot sell the unwanted parts as new parts.
I don't really have a problem so long as sellers say they have assembled
them preferably in the listing or ortherwise in the terms, or highlight they
do it here, since I can least favourite the store and it becomes a non-issue.
