Going through my personal collection I came across a small parts container that
I used to store minifigure parts in. When I looked in it, I found the parts to
the minifigs from the Republic Gunship (7163)

 
Set No: 7163  Name: Republic Gunship
* 
7163-1 (Inv) Republic Gunship
638 Parts, 8 Minifigures, 2002
Sets: Star Wars: Star Wars Episode 2

The figures were never assembled/played with, but pulled from the bags and added
to the organizer. I put "Jedi Jimmy" together today for the first time and noticed
a minor flaw on his face. Do I need to list him has Used or can I list as New
with a comment about the flaw?

If you're positive you bought this new and never assembled it, then it's
new. I'm not sure why you would put it together if you're planning to
sell it, but technically it can still be considered new. For something this
badly damaged and this expensive, I would certainly put a comment and probably
a picture. Personally I would list as used. Otherwise you're just asking
for a claim against you.

I put it together before I thought about selling it. Rookie mistake on my part
to not look it up before putting it together. I assumed it wouldn't be worth
as much as it is because it wasn't a licensed character.

Also, this head appeared in multiple figures. Is it possible you chucked a used
head from a different figure in your minifigure parts bin?

I was thinking about that, but the only parts in the case were this one, the
4 clone troopers and 2 super battle droids, all from the same set.

become Used.

just add a comment to the listing that original head is flawed and providing
a new, untarnished head along with the figure?

AFAIK (remember Discussions Moderators are ordinary members, and not in charge
of policing shops), it’s not forbidden to join “supplementary” parts to an official
entry.

What’s not okay is to:
— sell Used as New,
— or to replace some parts (with other IDs) and still use the official entry.

As for comments, I think it’s always best when the seller is clear (minifigure
assembled, etc.).

AFAIK (remember Discussions Moderators are ordinary members, and not in charge
of policing shops), it’s not forbidden to join “supplementary” parts to an official
entry.

Removing the head and replacing with another “new” head would not make it used.
I’d never list something purchased from another bricklink seller as new unless
it came sealed in the original bag, but there are lots of sellers who would.

I would never do it. Just saying what the policy is. This could definitely be
considered handling for sorting and selling the figure assembled. Like I said
in my other post, I’d sell used with an accurate description. Otherwise you’re
asking for a return.

in a display case overnight, it is used. If he assembled it and put it back in
storage, it remains new.

I was thinking about that but then wondered would that still be considered "new"
if a part came from another seller and not directly from LEGO or a new LEGO I
opened? Maybe I am overthinking this.

From a legal point of view, if you are an business and bought the items new from
another business (and have not played with it) you may resell it as new. However,
if you are a private person, or you bought the items from a private person, it
is used even if you have never played with it.

In this particular case... new but damaged? What's the point in selling it
as new? Do you think it will go for a higher price? It is damaged! Sigh...

The figures were never assembled/played with, but pulled from the bags and added
to the organizer. I put "Jedi Jimmy" together today for the first time and noticed
a minor flaw on his face. Do I need to list him has Used or can I list as New
with a comment about the flaw?

I don't consider anything as 'New' if it has been taken out of its
LEGO packaging and spent some time out in the world.

List it as Used with comments that it is in great condition except for the flaw
on the head. Then you can be sure to meet buyer expectations. Used minifigs sell
just as well as New in my opinion.
