| Hello,
I bought for 3500 $ of new/sealed boxes on Bricklink.
I paid 500$ to EMS for shipment.
I paid 250$ in taxes to custom, so 4250 $ in total.
The seller send me the boxes, but they arrived in crashed (not new at all) condition.
The seller asked me to fill a dispute, but he declared only 60$ of value instead
of 3500$, so he didn't get any refund from his side.
Now he is telling me that I must accept the loss, that I do not ask for any inssurance.
Is it legit ? It seems to me Bricklink provide an assurance the the buyer.
For such a huge amount, I must undestand how this was possible. My loss is huge.
Please share me your thoughs

Bricklink does not provide any assurance for the transaction between you and
the seller, you will need to discuss whether there is any insurance with your
payment provider (such as paypal, or however you paid.)

| I am sorry this happened to you.
Personally I would never ever buy for such a high amount of $’s on distance.
I would collect it and if not possible I wouldn’t risk it.
But that is just me speaking for myself.
Also, if I would have bought Lego (or anything else) for such a value I certainly
wouldn’t take the risk of NOT taking any insurance at all, not as a seller, not
as a buyer.
I cannot imagine a seller would ship such a high value go uninsured, but also,
that is me speaking for myself.
The risk is too high.
A seller should pack sets or any other Lego in such a manner that the chance
of damage is as small as possible, how was it packed?
Of course shipping an item (over long distances and over a longer time) can cause
damage whatever protection is used.
New sealed by the way can always mean a box has some damage or shelfwear but
a seller could mention this in the description.
Bricklink is only a website that provides sellers/shops to sell their items and
buyers to buy, they do not provide you any insurance, track and trace or whatever.
That is between buyers and sellers only.
Good luck, I hope you can find a reasonable solution!

Hope you paid with Paypal. If so open a case.
I can't imagine a $ 500 delivery not including insurance.

How did they calculate $250 import charges if $60 value was declared?

Gotta be VAT on the shipping charge.

Doesn’t work either: VAT is 20% in France.
$250 is 20% of $1250, which matches with nothing in the story.
Plus, there should be duties on such a big shipment. I think the flat rate is
2.5% (so $87.5) or 3% ($105).
As for the $60 value, I think it’s the max default insured value for the shipping
company, not the value on the CN23. They didn’t want to pay the extra for real-value
insurance.

Probably customs calculated the tax from MSRP price of the set instead of free
market price. (if said set is somewhat old and discontinued)
