I don't know the show or how these things work, but I am surprised that LEGO's
licensing department didn't think of this. I strongly doubt that they just
decided to risk it. But I'm also surprised that LEGO wouldn't have settled
this before a lawsuit came up, unless the lawsuit was the first they heard of
it as well.

Indeed!

I have to think that if they had asked in advance the jacket designer would have
been delighted to have a LEGO made of his work, though he might have worn a poker
face until all the arrangements were in place.

Oddly enough, I just bought five earlier this week because I needed to restock
my the brick profiles.

I'm no stranger to copyright infringement lawsuits (which some outlets are
stating this is), and he's got a looooong row to hoe and a looooot of obstacles
to overcome. This is clearly - at most - a derivative work but even then the
only identifiable similarity is the slightly tilted head.

Lego could also claim that the part is parody, which is protected speech in the
United States.
