We got an invoice from UPS for import duty charged for a bricklink order, on
which we already paid sales tax. Anybody knows what the law says on this matter?

Is it any actual duty, or is it UPS charging a customs brokerage fee ?

For some reason I want to say that a duty might exist, but only if the declared
value of the shipment is way up there.

I am in Canada, but I know this.
Sales tax has nothing to do with import fees (including duties). In the USA,
goods imported of total value above certain amount ($850 ?) is subject to import
fees.

Ouch. For some reason that's ended up being completely mis-classified on
import. 8301.40 is the tariff code for padlocks and locks of base metal. You'd
have to look up on usitc.gov for the exact detail of 8301.40.6060 - that site
doesn't load results for me, and the UK equivalent doesn't specify 8301.40.60
at all.

No idea what, if anything, you can do about it though - I'd assume that if
the parcel had the correct customs form on it listing it as toys then you'd
be able to get this corrected, but who knows with government agencies.

The harmonization code is wrong as the pervious poster stated.

The code I usually see on Lego is: 95030090

Here is how you fix it:

1. email ups import help:
aknentyrvw@ups.com

2. Provide them your tracking number
3. State the harmonization code is incorrect on the import form and provide them
the correct code: 95030090

They may be able to fix it for you.

You see where it says 'Duty Class 8301.40.6060' ? You shipper/supplier
totally f'ed up the customs information.

That is the code for 'OTHER LOCKS' having to do with furniture.

My suggestion is that you refuse the order, tell them to send it back, and tell
your supplier to stop sending out stupid customs forms. Maybe if they have to
eat the costs (both ways) they will learn something (like do not engage in international
shipping without knowing what you're doing).

I wonder if UPS gave the harmonization code based on the description? That seems
like a very strange code for a Lego seller to use.
