| This definitely is poor taste by this store, I don't think this is disallowed
per BrickLink rules but it would certainly land this store on my dislike stores
list, both for unhelpful individual listings and punishing terms of service.
I am selling a Power Function IR receiver I have no way to test, and it is clearly
indicated in the item description and I would refund it if a buyer told me it
didn't work. Especially if it was very cheap I don't understand their
reluctance to refund.

I believe selling broken electronics is allowed, though how this seller went
about it is very poor. If we have no way to test an electronic, then we usually
don't sell it. If we do test it and it doesn't work, we make sure to
clearly state so.
I don't think that is very good business practice on the sellers side, however
on the other hand, you as the buyer are responsible to check descriptions for
damage before purchasing the item (especially on cheap used pieces ).

For an item that isn't fit for its expected use there should be a note added
to the item description. It isn't good enough to have a general disclaimer
buried in the store terms and conditions. If the seller won't refund, file
a Paypal claim for "not as described"
I had a buyer contact me this week because a motor that I described as "tested
and working" didn't work. I refunded them completely and asked whether they
were sure the problem wasn't the connecting wire or battery box they were
using. Sure enough there was a loose connection in the battery box. In fact their
old was working all along - there was no need to order a new one. So they returned
the refund to me.
My experience with Bricklink has overwhelmingly been that you don't need
detailed store terms if you just treat people decently.

I'm in agreement with other sellers that if the description of the item didn't
say "not tested" but there was only something buried in the terms that you should
file a PayPal claim. I'd recommend contacting the seller first despite what
he or she states in the terms.

The correct listing should have read "untested, sold as-is"
