Dear BrickLink members,

On July 1, to accompany the EU VAT Marketplace implementation, we will be making
a few small changes to our Terms of Service. The changes are listed here:

From the General Terms:

4. General Statements Regarding Fees and Taxes:

Simply becoming a registered user on the Site is free and BrickLink does not
charge you any fees for simply being a registered user.
Of course, as a Buyer of an item from a Seller, you must pay the Seller for the
item you purchase from the Seller.

In addition, certain US states require marketplace facilitators such as BrickLink
to collect sales tax directly from the Buyer. If the shipping address for an
order is in one of these states, state sales tax will be applied to the order
regardless of where the Seller is located. Due to technical complexity and the
need for accurate recordkeeping, BrickLink may restrict the type of payment methods
available for all such orders.

Sellers are subject to pricing and payment terms in the Seller Terms (as defined
below).
Designers are subject to pricing and payment terms in the Designer Terms (as
defined below).

Will now read:

Of course, as a Buyer of an item from a Seller, you must pay the Seller for the
item you purchase from the Seller.

In addition, certain countries and regions require marketplaces such as
BrickLink to collect and remit transaction taxes (e.g. sales tax, VAT, GST, etc.)
directly from the Buyer. If the shipping address for an order is in one of these
countries or regions, transaction tax may be applied to the order. Due to technical
complexity and the need for accurate recordkeeping, BrickLink may restrict the
type of payment methods available for all such orders.

Sellers are subject to pricing and payment terms in the Seller Terms (as defined
below).
Designers are subject to pricing and payment terms in the Designer Terms (as
defined below).

From the Seller Terms:

1.3.9 Value Added Tax (VAT):

If you have enabled VAT in your store, your fees due to BrickLink will be based
on the sum of the order net prices for the items in the order, which net prices
exclude VAT (i.e., we do not charge Fees on VAT amounts). If you are a VAT-registered
Seller in the EU, you must enable VAT in your store and submit your VAT ID to
the Site. All submitted VAT IDs will be verified electronically and the VAT ID
and the registered name of the store will be displayed on the store front. If
you are a Seller in the EU who has not enabled VAT in your store, a VAT charge
will be added to your bill for all BrickLink fees you incur on the Site. The
percentage of VAT will be determined by the national VAT rate of your country.
VAT-enabled stores will need to handle VAT through self-accounting practices.

Will now read:

1.3.9 Value Added Tax (VAT) and similar taxes on Fees:

Where applicable, VAT will be applied on fees charged by BrickLink. If
you have enabled VAT in your store, your fees due to BrickLink will be based
on the sum of the order net prices for the items in the order, which net prices
exclude VAT (i.e., we do not charge Fees on VAT amounts).

**************************************************************

1.4 Tax Obligations:

In addition to paying taxes on BrickLink fees, you are responsible for handling
all applicable taxes on the items that you sell from your store. However, for
orders shipping to an address in certain US states, BrickLink will collect sales
tax directly from the Buyer.

handling all applicable taxes on sales from your store. However, for orders shipping
to an address in certain countries or regions where BrickLink is subject to marketplace
legislation, BrickLink will collect and remit transaction taxes (e.g. sales tax,
VAT, GST, etc.) directly from the Buyer.

Does that mean you’re totally removing the VAT mechanism on BL and VAT-registered
sellers will have to handle domestic VAT by themselves?

No, it's just that we are not defining this in the Terms.

Oh okay.  Actually makes sense.  Even more as there’s more and more taxes to
handle.

Sorry, got a little scared for a minute, thanks for the prompt answer

Wouldn't the preposition (to) fit better than (on) in first sentence? "Where
applicable, VAT will be applied on fees charged by BrickLink"

Better yet "Where applicable, VAT will apply to fees charged by BrickLink"

Silly that it bothers me at all, though

There are probably some tweaks we could make for a later version, but right now
we managed to get this through three different teams for approval with only a
couple days left until the deadline. So for now we'll need to go with this.

How does this work with invoicing? Do I need to calculate the vat, or is that
done for me? Of course I am using onsite payment, but I notice that taxes and
such are not calculated for me when buyers use invoiced shipping methods.

Sales taxes are absolutely collected for you when buyers use invoiced
shipping methods from any state where it is required. (Most of them.)

Make sure you have all the necessary columns visible on your Orders Received
page so you can be more aware of this.

It also shows on the Order Detail and Edit Order pages. It should show on your
invoice, but may not if you are using a custom template.

Good luck,
Jen

Could someone please assist in parsing the phrase "In addition to paying taxes
on BrickLink fees".

Does that imply that once a state is turned on (e.g Florida on 1 July) that monthly
statements from BL will have a total of fees due, plus a Florida State sales
tax on top of the BL total ?

I think that's hypothetical. I definitely do not pay taxes on BL fees but
I understand that they are subject to VAT

Correct. This is referring to VAT and other types of taxes on the fees. VAT is
only one type of tax that could be applied to a fee. Currently I am not aware
of any US state sales tax that includes services like BrickLink, but I have been
told this may be a possibility in the future.

Part of me wants to reach out to the State of Florida, Department of Revenue.
to double check this, but another part of me doesn't want to disturb a sleeping
