| Dear BrickLink members,
On July 1, to accompany the EU VAT Marketplace implementation, we will be making
a few small changes to our Terms of Service. The changes are listed here:
From the General Terms:
4. General Statements Regarding Fees and Taxes:
Simply becoming a registered user on the Site is free and BrickLink does not
charge you any fees for simply being a registered user.
Of course, as a Buyer of an item from a Seller, you must pay the Seller for the
item you purchase from the Seller.
In addition, certain US states require marketplace facilitators such as BrickLink
to collect sales tax directly from the Buyer. If the shipping address for an
order is in one of these states, state sales tax will be applied to the order
regardless of where the Seller is located. Due to technical complexity and the
need for accurate recordkeeping, BrickLink may restrict the type of payment methods
available for all such orders.
Sellers are subject to pricing and payment terms in the Seller Terms (as defined
below).
Designers are subject to pricing and payment terms in the Designer Terms (as
defined below).
Will now read:

There are probably some tweaks we could make for a later version, but right now
we managed to get this through three different teams for approval with only a
couple days left until the deadline. So for now we'll need to go with this.

How does this work with invoicing? Do I need to calculate the vat, or is that
done for me? Of course I am using onsite payment, but I notice that taxes and
such are not calculated for me when buyers use invoiced shipping methods.

Sales taxes are absolutely collected for you when buyers use invoiced
shipping methods from any state where it is required. (Most of them.)
Make sure you have all the necessary columns visible on your Orders Received
page so you can be more aware of this.
It also shows on the Order Detail and Edit Order pages. It should show on your
invoice, but may not if you are using a custom template.

Could someone please assist in parsing the phrase "In addition to paying taxes
on BrickLink fees".
Does that imply that once a state is turned on (e.g Florida on 1 July) that monthly
statements from BL will have a total of fees due, plus a Florida State sales
tax on top of the BL total ?

Correct. This is referring to VAT and other types of taxes on the fees. VAT is
only one type of tax that could be applied to a fee. Currently I am not aware
of any US state sales tax that includes services like BrickLink, but I have been
told this may be a possibility in the future.

Part of me wants to reach out to the State of Florida, Department of Revenue.
to double check this, but another part of me doesn't want to disturb a sleeping
dawg.
